Trust Types
Which Trust Is Right for You?
We prepare the four main trust types for California and Florida. Not sure? Start with a revocable living trust — the attorney confirms the fit at review.
Revocable Living Trust
You keep full control while you live: you are the grantor and usually the trustee, and you can amend or revoke the trust at any time. Assets in the trust pass to your beneficiaries without probate.
Best for: most homeowners and families who want to avoid probate and keep control.
Irrevocable Trust
Once created, it generally cannot be changed or revoked. Assets move out of your estate, which can protect them from creditors and may reduce estate-tax exposure.
Best for: larger estates, asset protection, and advanced planning.
Special Needs Trust
Provides for a loved one with a disability without disqualifying them from needs-based public benefits such as SSI or Medi-Cal. Distributions are made for supplemental needs.
Best for: families caring for a beneficiary with a disability.
Testamentary Trust
Created through your will and takes effect only after you pass. Useful for holding assets for minor children until they reach an age you choose.
Best for: parents of young children planning through a will.

- Which states do you serve?
- California and Florida only. Attorney Dehen is licensed in both states, so your documents reflect the correct state law — the California Probate Code or the Florida Trust Code.
- What if my estate is complicated?
- Complicated matters — business succession, multi-property estates, significant estate-tax planning, or blended-family complexity — are quoted individually as Custom Estate Planning, after an eligibility review.
- How long does it take?
- Your drafted PDF usually arrives within minutes of completing intake. Attorney review and final delivery timing depend on the complexity of your estate and revision rounds; your engagement terms set expectations for your matter.
- Can I make changes later?
- Yes. Reply to the email your draft arrives with and describe what you want changed. Each round of basic changes is $100. The revised file goes back to the attorney before any final version.
- Can Dehen Law serve as my trustee?
- Attorney-as-trustee service is handled separately from these plans. It requires a written trustee agreement and fee arrangement reviewed and approved by Attorney Dehen — mention your interest in your intake notes and she will follow up.
